These Terms of Service ("Terms") govern your access to and use of the website located at altitudeenter.com (the "Site") and the tenant maintenance text-messaging program ("PropPulse" or the "SMS Program") operated by Altitude Enterprises LLC ("Altitude Enterprises," "we," "us," or "our"). By accessing the Site or by sending a message to our maintenance text line, you agree to these Terms.
1. Who We Are

2. Use of the Site
You may use the Site for lawful, personal, and non-commercial purposes only. You agree not to:
- Use the Site in any way that violates applicable law or regulation.
- Attempt to gain unauthorized access to any portion of the Site, our servers, or any related systems.
- Use any automated means (bots, scrapers, etc.) to access the Site in a manner that imposes an unreasonable load on our infrastructure.
- Submit false or misleading information through any form or contact channel on the Site.
- Interfere with or disrupt the integrity or performance of the Site.
3. SMS / Text Messaging Program
Program purpose
The SMS Program is a tenant-service channel for receiving maintenance requests from tenants of properties managed by Altitude Enterprises LLC. It is not a marketing program. Use of the SMS Program by anyone other than a current tenant of a property we manage is not authorized.
How tenants opt in
Tenants are given the maintenance text line as part of their move-in materials and a lease addendum titled "Maintenance Text Line — Consent to Receive SMS Replies." By texting the maintenance line, the tenant consents to receive SMS replies from the program in connection with their maintenance request.
Message frequency, fees, and carriers
- Message frequency varies and depends on the tenant's interactions with the program.
- Message and data rates may apply, depending on the tenant's mobile plan and carrier.
- Mobile carriers are not liable for delayed or undelivered messages.
STOP and HELP
You may opt out of the SMS Program at any time by replying STOP to any message from the program. Reply HELP for assistance and contact information. Standard messaging keywords are honored as required by applicable carrier and regulatory guidelines.
Honest, accurate, and appropriate use
You agree to use the SMS Program only to communicate genuine maintenance requests relating to your tenancy and to provide accurate information. You agree not to use the SMS Program to transmit abusive, threatening, fraudulent, or unlawful content. We reserve the right to discontinue SMS interactions with any user who misuses the program.
4. Property Management Services
The Site describes services offered by Altitude Enterprises LLC. Any actual provision of property management services is governed by a separate written agreement between Altitude Enterprises LLC and the property owner. Nothing on the Site constitutes an offer to provide services, and no contractual relationship is created by visiting the Site or by submitting an inquiry through it.
5. Intellectual Property
The Site, including its text, graphics, logos, images, and software, is owned by Altitude Enterprises LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any portion of the Site without our prior written consent, except for personal, non-commercial use such as printing a single page for your own reference.
6. Third-Party Links
The Site may contain links to third-party websites that we do not control. We are not responsible for the content, accuracy, or practices of any third-party website, and inclusion of a link does not imply our endorsement.
7. Disclaimers
The Site and the SMS Program are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Altitude Enterprises LLC disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site or the SMS Program will be uninterrupted, error-free, or free of viruses or other harmful components.
The SMS Program is intended as a convenient way to log a maintenance request, not as a channel for life-safety emergencies. In the event of an emergency that threatens life or property, call 911 or the appropriate local emergency number.
8. Limitation of Liability
To the fullest extent permitted by law, in no event shall Altitude Enterprises LLC, its officers, directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of or in connection with your use of, or inability to use, the Site or the SMS Program.
9. Indemnification
You agree to indemnify, defend, and hold harmless Altitude Enterprises LLC and its affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Site or the SMS Program, or your breach of these Terms.
10. Governing Law and Venue
These Terms and any dispute arising out of or related to them or your use of the Site or the SMS Program are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. You agree that the exclusive venue for any dispute arising under these Terms shall be the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Continued use of the Site or the SMS Program after a change becomes effective constitutes your acceptance of the updated Terms.
12. Privacy
Your use of the Site and the SMS Program is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
13. Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.
